Terms of Service

TERMS OF SERVICE

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the services provided by BlindStairs S.L. (“BlindStairs,” “we,” “us,” or “our”), including our website, application, API, and recruitment intelligence software (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization (a “Company”), you agree to these Terms on behalf of that organization and represent that you have the authority to do so.

2. Definitions

  • “Company”: The legal entity or business using BlindStairs to source, screen, or manage candidates.
  • “Professional” (or Candidate): An individual user registered on the platform to find employment opportunities.
  • “Services”: The BlindStairs platform, including the SaaS dashboard, API, and associated tools.
  • “Customer Data”: Data uploaded by the Company (job descriptions, criteria) or the Professional (CVs, profile data).

3. Access and Use of Services

3.1 License Grant

Subject to your compliance with these Terms and payment of applicable fees, BlindStairs grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business (for Companies) or personal (for Professionals) purposes.

3.2 Restrictions

You agree not to:

  • Reverse engineer, decompile, or attempt to discover the source code or underlying algorithms of the Services.
  • Use the Services to build a competitive product or service.
  • Use the Services for any illegal purpose, or in violation of any local, state, national, or international law (including EEOC, GDPR, and Labor Laws).
  • Scrape, spider, or crawl the Services using automated means.

4. AI & Decision Making (Crucial Disclaimer)

4.1 Decision Support Tool

BlindStairs is a decision-support intelligence layer. We do not make hiring decisions. The Company retains full and sole authority, responsibility, and liability for all employment decisions, including interview selection, offers, and rejections.

4.2 Algorithmic Transparency

While BlindStairs takes every measure to ensure our algorithms are fair and bias-reduced (audited under the EU AI Act), we cannot guarantee that the Services are entirely free from error. The Company is responsible for reviewing AI-generated recommendations before acting on them.

5. User Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and API keys. You must notify us immediately of any unauthorized use of your account. BlindStairs is not liable for any loss or damage arising from your failure to protect your credentials.

6. Intellectual Property

6.1 Our IP

The Services, including all design, text, graphics, logos, and software, are the exclusive property of BlindStairs S.L. and are protected by copyright and trademark laws.

6.2 Your Data

You retain ownership of all data you upload to the Service (“Customer Data”). You grant BlindStairs a worldwide, royalty-free license to use, host, store, and display your Customer Data solely as necessary to provide the Services to you.

7. Fees and Payment

For Companies on paid tiers:

  • Subscription: Fees are billed in advance on a monthly or annual basis.
  • Cancellation: You may cancel your subscription at any time. Access will continue until the end of the current billing cycle. No refunds are provided for partial months.
  • Taxes: All fees are exclusive of applicable taxes (VAT, GST), which will be added to the bill where required by law.

8. Confidentiality

Each party agrees to protect the other party’s Confidential Information with the same degree of care it uses to protect its own. BlindStairs will not disclose Company hiring data or Professional personal data to third parties except as required to provide the Service or by law.

9. Limitation of Liability

To the maximum extent permitted by law, BlindStairs S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. In no event shall our aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
